Welcome to Jaquet Health & Safety. By accessing or using our website, services, or purchasing our products, you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you must not use our website or services.

1. About Us

This website is operated by Jaquet Health & Safety ABN 29 766 194 885. We provide:

  • General physiotherapy and occupational health consulting

  • Workplace rehabilitation and ergonomic assessments

  • Hearing protection services (ear impressions, fit testing, education)

  • Sale of custom and universal hearing protection products

  • Fitness programs, eBooks, and training resources

2. Use of Website

  • You must be at least 18 years old to purchase products or book services.

  • You agree not to misuse this website (e.g. upload harmful code, attempt to access data without permission).

  • We may suspend or terminate access if these Terms are breached.

3. Products and Services

  • Custom products are made to order and are non-refundable unless faulty (see Section 7).

  • Universal products may be returned in accordance with our Refund Policy.

  • Services (physiotherapy, consulting, programs) are provided by qualified professionals but are not a substitute for medical emergency care. Clients are responsible for following advice safely and seeking additional medical guidance where required.

4. Payment

  • All prices are in Australian dollars (AUD) and inclusive of GST unless otherwise stated.

  • Payments must be made at the time of booking or purchase via approved methods (Stripe, bank transfer, or as otherwise agreed).

  • Invoices must be paid by the due date stated. Late payments may incur additional fees.

5. Cancellations & Rescheduling (Services)

  • Appointments cancelled or rescheduled with less than 24 hours’ notice may incur a cancellation fee.

  • Refunds are not provided for change of mind once a service has been delivered.

6. Intellectual Property

All content on this website, including eBooks, programs, training resources, branding, and graphics, is owned by Jaquet Health & Safety unless otherwise stated. You may not copy, reproduce, or distribute our content without written permission.

7. Refunds, Replacements, and Warranty

7.1 General Refund Policy

  • Our Refund Policy forms part of these Terms and applies to all products and services.

  • Refunds are not provided for change of mind.

  • Services are covered under the Australian Consumer Law (ACL) for major failures but are otherwise non-refundable once delivered.

7.2 Custom Hearing Protection – Manufacturer Warranty

  • All custom hearing protection products supplied by Jaquet Health & Safety are manufactured by Pacific Ears Australia / ACS Custom.

  • Warranty periods vary depending on the product, generally:

    • Up to 4 years for custom-made earplugs,

    • 1 year for electronic products,

    • 1–2 years for universal products, depending on model.

  • Warranty covers defective manufacturing, material faults, or component failure.

  • Warranty does not cover misuse, accidental damage, wax/moisture build-up, or unauthorised modifications.

7.3 Fit and Ear Impressions

  • Proper fit depends on high-quality impressions. Jaquet Health & Safety is trained and authorised to take impressions to manufacturer standards.

  • Fit adjustments must be requested within 30 days of delivery. The first alteration is free of charge (manufacturer terms apply).

  • If impressions do not meet manufacturer requirements, a re-take may be required. If the client declines, the manufacturer may not guarantee fit or seal.

7.4 Returns of Universal Products

  • Universal (non-custom) products may be returned within 14 days of delivery if unopened, unused, and in original condition.

  • For hygiene reasons, opened universal products cannot be returned unless under warranty.

7.5 Responsibility & Liability

  • Jaquet Health & Safety provides impression-taking, sales, and distribution services but does not manufacture products.

  • By purchasing custom hearing protection, you acknowledge that Pacific Ears Australia / ACS Custom is solely responsible for product warranty and manufacturing obligations.

  • Jaquet Health & Safety will assist with warranty claims but ultimate responsibility rests with the manufacturer.

7.6 Shipping & Repairs

  • Custom orders generally take 10–15 business days from when impressions are received by the manufacturer.

  • Products repaired or replaced under warranty are shipped at the manufacturer’s expense.

8. Limitation of Liability

  • We take all reasonable care in providing our products and services, but we do not guarantee that they will always meet every individual expectation.

  • To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages resulting from use of our services or products.

  • Clients are responsible for using hearing protection correctly and following exercise or rehabilitation programs safely.

9. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia, and disputes will be handled in the relevant courts of Queensland.

11. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on our website with the “Last updated” date. Continued use of our website or services after updates constitutes acceptance of the revised Terms.
